Shipping Terms

Unless otherwise agreed by the parties shipment of the goods are made F.O.B our warehouse deck.  

Generally most of our products of our products ship within two business days and usually arrive in 5-10 business days depending upon your location within the 48 contiguous lower states. All products shall be deemed to be delivered and risk of loss relating to shipment shall pass from Klimaire (Seller) to Customer (Buyer) at such time as product is loaded onto a transportation carrier vehicle. We will email you your tracking number soon as it is shipped out. Buyer is free to arrange and pay for its own shipping and handling F.O.B. Seller's facility. All claims by Buyer for damage, loss or delays in transit shall be made by Buyer against the carrier, and Seller shall have no responsibility or obligations with respect to any such damage, loss, or delay. If Seller arranges transportation for Buyer, such arrangements shall be at Buyer's sole risk and expense, and transfer of title and risk of loss as specified above shall not be affected. Seller reserves the right to ship prior to the scheduled shipping date and to ship to and invoice Buyer for a quantity of products, which may vary up to 10 percent (10%) over or under the quantity requested by Buyer. Unless otherwise agreed in writing by the parties, all products will be packed for shipment in accordance with Seller's standard practices, and packing methods, shipping documents and manner, route and carrier of shipment shall be at Seller's sole discretion.

Buyer is responsible to inspect such containers and equipment for damage caused by the carrier and to promptly notify carrier and Seller of any damages found.While shipping is free within the 48 contiguous lower states, there is a charge for the optional lift-gate service if you choose it. Lift-gate is a delivery service in which a special truck with a power gate on the back will lower your order to the ground for you. Carrier is not obligated to perform such service when suitable vehicles equipped with such devices and operators are not available, or when such equipment is not available through a contractor or rental agency. When lift-gate equipment is not available and carrier’s personnel utilize alternate means to move the freight from the vehicle to ground level, the lift-gate charges named herein will apply. Lift-gate services will only be rendered at locations that are safe and accessible to the vehicle. If you don't choose lift-gate service, please be available to assist the driver with unloading your order off the truck.Acceptance – Cancellation – ReturnTitle to and risk of loss of, the Products shall pass to Buyer as soon as the Products are delivered by seller to the carrier.

Each shipment date is approximate, and Seller shall not be responsible for any damages of any kind resulting from any delay in shipment or delivery of any Products. Acceptance of any shipment of products shall be presumed conclusively to have occurred fifteen days following delivery of products to Buyer, unless Buyer has accepted the products prior to that date. Buyer shall carefully inspect all deliveries of products upon receipt and report to Seller promptly any alleged error, shortage, defect or nonconformity of such products. Buyer waives any claim or right to revoke acceptance if Buyer fails to so inspect and report promptly. For all goods any non-acceptance or cancellation of any order for products which is not consented to in writing by Seller shall entitle Seller to recover cancellation charges which includes the full price of the products or services as well as all other costs incurred by Seller related to sale of such products.  Standard products regularly maintained in stock by Seller which can in the normal course of business be resold by Seller and which are in re-sellable condition may, with Seller’s written consent, RMA, (Return Merchandise Authorization), be returned by Buyer for credit less a restocking charge. All returned products must be shipped to Seller, freight prepaid, at Buyer's risk of loss or damage.
